This document outlines the Terms and Conditions for Users of the clickSAABS websites.
1. Fees and Services
1.1 Services
The use of clickSAABS implies the Users acceptance of all terms and Conditions.
clickSAABS is an interactive On-line Auction Venue. We are not Auctioneers rather we publish items submitted by "Users". clickSAABS is not invloved in the actual transaction between buyers and Sellers.
clickSAABS has no control of the safety, quality or legality of the items advertised. clickSAABS assumes that the Users list the items in good faith and accuracy.
clickSAABS is not responsible that a Buyer and Seller will actually complete the transaction. clickSAABS does not own the items listed and, therefore, cannot transfer ownership from the Seller to the Buyer.
The User, after registration will be able to use the services of clickSAABS.
clickSAABS shall have the discretion to register or deny access to clickSAABS Users at any time.
clickSAABS reserves the right to modify or discontinue any feature of the clickSAABS websites including but not limited to content, systems and hours of availability at any time without the need for prior notice.
In no event is clickSAABS liable for any loss or damage including indirect or consequential loss or damage.
1.2 Fees
There is no charge to list a standard classified advert or auction with clickSAABS.
All fees associated with the use of the clickSAABS service are listed on the fees page (accessed via the Fees link at the bottom of every page)
Unless otherwise stated all fees will be in GBP (British Pounds Sterling). You are responsible for any and all fees associated with using the services of clickSAABS.
We reserve the right to change the fees without any prior notice to the user.
2. Bidding and Buying
The User agrees to comply with all the terms and conditions hereof. The right to use clickSAABS is agreeable by the User and not transferable.
Registration and Bidding is free on clickSAABS however you must register before you are able to Bid on or Sell items.
As a Seller you are obliged to describe reasonably and accurately the goods for sale or for auction including any defects, any parts missing or any other aspect that would affect the buyers understanding of the sale or auction.
As a Seller you are obliged to sell the item to the winning Bidder for the price as stated at the end of the Auction.
As a Buyer, you are commited to buy the item from the Seller at the price stated at the end of the Auction. (if you are the winning Bidder)
3. Listings
Standard listings are free to all individuals and all traders. A standard listing includes at least one photograph.
You may upgrade your listing for a nominal charge (see 1.2 Fees) to highlight and/or feature your listing in order to give it greater visibility. These fees will be paid before the item is listed.
You may not list any email addresses, telephone numbers, alternative URLs (website addresses) or links to externally hosted images.
You must be the legal owner of the item that you intend to list.
4. Confidentiality
The User is responsible for the confidentiality of his or her User names and Passwords.
The User is responsible for any activity in their account. Any suspected fraudulent activity must be reported immediately via the contact form on our website with the word FRAUD in the subject title.
5. Permitted Uses
The User shall use the site for Lawful purposes only. Users shall not post any items or material which infringes in any way the rights of others. Users shall not use the site in ways which is invasive of Privacy laws. Therefore the User agrees not to breach any rules of use of the internet or laws applicable to the country the User resides.
The User does not have the right to use clickSAABS content without the prior written authorisation of clickSAABS.
The User does not have the right to limit or constrain any other User from Using clickSAABS.
Users shall not use clickSAABS to advertise any commercial solicitation including but not limited to, the solicitation of Users to become subscribers of other on-line informational services competitive with clickSAABS.
Users shall not upload or post any material protected by copyright or trademark without the permission of the owner of the copyright.
Any material submitted to clickSAABS by the User automatically grants clickSAABS the non exclusive rights to use and publish the image and information.
The User also permits other Users to access, view, store or reproduce the material for the Users personal use.
6. Disclaimer
The User agrees that the Use of clickSAABS is entirely at the Users sole risk.
Neither clickSAABS, its affiliates nor any of their respective employees, agents, 3rd party providers warrant that clickSAABS will be uninterrupted or free of errors. Although every precaution will be taken to avoid such action.
clickSAABS do not make claims to the success, reliability or content of any listing.
No guarantees are made to the outcome of each listing, nor are there any warranties on any product sold via clickSAABS. clickSAABS do not own any of the products. clickSAABS only facilitates the separate transaction between the buyer and the Seller. (Users)
7. Monitoring
clickSAABS has the right, but not the obligation, to monitor the content on its websites to determine suitability, satisfy laws and terms and conditions.
clickSAABS has the right to edit, refuse or remove any material posted without any prior notice being given.
8. Termination
clickSAABS may terminate this agreement at any time or a Users account in the event of misconduct, unacceptable behaviour or any breach or any agreement.
9. Refund Policy
clickSAABS does not offer any refund on Membership Fees.
clickSAABS does not offer any refunds for listing or success fees.
No guarantees are made to the outcome or success of each listing.
There are no warranties given by clickSAABS to any product which is sold via the website. However, there may be a warranty or returns policy offered by the Seller of the goods. Please refer to each individual listing.
The User is responsible for his or her User name and Passwords. If fraudulent activity is suspected within your account, it must be reported immediately via our contact form using the word FRAUD in the subject.
In the case where the activity is proven to be fraudulent and unauthorised amounts have been charged to your account, a refund or credit will be issued totalling that amount.
In the unlikely case of the above, the method of refund will be via the payment method you currently have on file. Before such time, please verify that all your contact information is correct by clicking on "My Account"
